Mediation

We represent clients at private mediations and at mediations ordered by a circuit court, before a lawsuit is filed or while one is pending.

We help choose the mediator, write the mediation statement and prepare the client for the day. At the mediation we negotiate for the client, and if the case settles we draft the settlement agreement the parties sign.

The mediator does not decide the case, and there is a settlement only if the parties agree to one. What is said in a mediation is confidential under Oregon law and generally cannot be used in the case if it does not settle.
